MORAVIA JOINT FIRE DISTRICT
RESOLUTION #2018-002 AUTHORIZING THE PURCHASE OF ONE (1)
2018 CUSTOM BUILT PUMPER
ON A 2013 SPARTAN CAB & CHASSIS
Upon motion duly made, seconded, and carried, the following resolution was adopted by affirmative vote of a two-thirds majority of the Commissioners of the Moravia Joint Fire District, at a duly called meeting of the Commissioners on the 20th day of February, 2018, a quorum being present:
BE IT RESOLVED, by the Board of Fire Commissioners of the Moravia Joint Fire District in the Town of Moravia, County of Cayuga and State of New York as follows:
Section 1. The purchase and financing of a 2018 custom built pumper on a 2013 Spartan Cab and Chassis at a cost not to exceed $505,000.00 as defined in the General Municipal Law Sec. 103(16), is hereby authorized.
Section 2. The plan of financing the cost of purchasing said fire truck is as follows: (1) by the issuance of Statutory Installment Bonds of said Fire District not exceeding $505,000.00, which are hereby authorized pursuant to the provisions of the Local Finance Law. Such bonds are to be payable from said Fire District, and the full faith and credit of said Fire District are hereby pledged for the payment of said bonds and the interest thereon.
Section 3. It is hereby determined that the period of probable usefulness of said pumper is Twenty (20) years, pursuant to subdivision 27 of paragraph (a) of Section 11.00 of the Local Finance Law.
Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell the statutory installment bonds herein authorized is hereby delegated to the Fire District Treasurer, the chief fiscal officer of the District. Such bonds shall be of such terms, forms and contents and shall be sold in such manner as may be prescribed by said Fire District Treasurer, consistent with the provisions of the Local Finance Law.
Section 5. The validity of such bonds may be contested only if:
- Such bonds are authorized for an object or purpose for which said Fire District is not authorized to expend money; or
- Such bonds are authorized in violation of the provisions of the Constitution of the State of New
Section 6. The resolution shall become effective after its approval by the duly qualified voters of said Fire District at a special election to be held on April 3, 2018, and;
WHEREAS, the adoption of said resolution requires that a special election be held pursuant to the Local Finance Law and Town Law of the State of New York to determine if the residents of the Town approve the purchase of said fire truck.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to Local Finance Law and Town Law of the State of New York that a special election of the qualified voters of said District be held on the 3rd day of April, 2018, and be it further
RESOLVED, that pursuant to the Local Finance Law and Town Law of the State of New York, that
- the election shall take place at the Moravia Fire House, located at 38 Keeler Avenue, Moravia, New York 13118;
- the polls shall open at 6:00 m. and close at 9:00 p.m.;
- the vote shall be by ballot; and
- the proposition to be voted on shall be the following:
PROPOSITION #2018-002:
Shall the resolution authorizing the purchase of One (1) 2018 Custom Built Pumper on a 2013 Spartan Cab and Chassis, at a cost not to exceed $505,000.00 to be paid as follows:
- The issuance of statutory installment bonds of said Fire District, not exceeding $505,000.00, duly adopted by the board of Fire Commissioners of said Fire District on Tuesday, February 20, 2018, be approved; and it is further
RESOLVED, that the appropriate legal notice of said special election shall be published in the Moravia Republican Register at least 27 days prior but no more than 34 days prior to said date of election; and it is further
